Legal Question in Personal Injury in New York

can i sue if i paid for a night at a hotel but had to check out early due to an infestation of bed bugs

they would not agree to give a refund

You can sue in Small Claims Court but it would be best if you had evidence, otherwise it is "they said, you said" and the plaintiff carries the burden of proof (51/49%). I would send a letter to the CEO first and let him know that legal action (and bad publicity) will come if you do not get a refund.
