Can I sue the Village I live in if one of their buses hit my truck?

I was driving to work and one of the village buses was headed in the opposite direction. I got over in my lane as far to the right as I could but a telephone pole was in the way. The bus could have moved over a little more but didn't and he hit my mirror with his mirror, breaking both. The head of transportation came down. I was late for work so we didn't call the police to the scene. Thinking about it now, though I'm really pissed off that I am going to have to pay to have this fixed, when I didn't do anything wrong! I don't want to submit it to insurance because I think the deductable will be higher than the cost of fixing the mirror.

The road is narrow and all the bus driver kept saying was ''well I maintained my lane'' ''I was in my lane'' but that doesn't give him the right to just plow into me! He could have and should have moved over just a few inches (there was no telephone pole on his side like there was on mine) and we wouldn't have hit.

Can I sue the Village for the damage to my truck? My tax dollars are going to pay for the bus to be fixed, so I am getting screwed on both ends.

You may bring suit, yes. A police report is not required. Be sure to look into the notice of claim rules for your "Village". If a notice of claim is required you must file this before starting a lawsuit, even in Small Claims Court. Good luck. Best, M. E. Zuller
