Legal Question in Personal Injury in New York

Can I sue New York's Metropolitan Transportation Authority for harassing passengers with recorded announcements?

I believe that automated recorded announcements of incoming trains that the MTA is forcing the passengers to listen to day in day out for months and years is harassment.

Here's my proposed complaint:

My questions are:

1. Can I sue the MTA under N.Y. Penal Law Section 240.26 for Harassment in the Second Degree?

2. Do I sue the MTA or the MTA Chairman Jay Walder who instituted the announcements?

3. What other legal options do I have to force the MTA to stop these automated recorded announcements of incoming trains in stations?

Anyone can start a lawsuit about anything. Whether there is a reasonable chance of success is really the issue. I do not believe your case would survive motion practice, on any proposed theory or cause of action. There is also a counterclaim called "abuse of process", which may be brought against persons starting frivolous claims. Best, M. E. Zuller
