Legal Question in Personal Injury in New York

Symptoms getting worse

I was involved in an automobile accident 15 months ago.The recent MRI's show that my discs have gotten worse and I am now feeling pain in my wrists, arms and fingers.Someone told me that the at fault party will only pay for injuries that were initially reported at the onset of said accident. Is this true?

Re: Symptoms getting worse

No any injury that has been medically linked to the accident is potentially compensable. As long as the doctors say that the new symptoms are related to the original injury then the new symptoms are part of any case you might have re this collision. You should consult a local attorney to get a free consultation. by reviewing the accident reposrt and the medical records that attorney will be able to help you chart your course from this point forward. If you would like my help in finding such an attorney, please let me know by replying to the email address listed below

Re: Symptoms getting worse

No Fault and a suit for paina nd suffering are two different things. No Fault pays for medical bills related to the injury and for some loss of time from work. You may have a viable personal injury case.

Re: Symptoms getting worse

The information you received is not exactly true. While it is harder to prove that later occuring injuries are caused by the initial injuries any injuries that can be shown to be directly caused by the accident can be compensable.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Re: Symptoms getting worse

Generally, you have three years to file a lawsuit in New York for personal injury (unless a municipality is involved). If your medical condition is found by a doctor to be directly related to and caused by your accident, then you may still be able to pursue your case. I invite you to contact me should you wish to discuss this further and explore all of your options.
