Time limit to sue someone

Is there a time limit to sue someone for a personal injury. On Dec 26th 2004 I fell on a patch of ice in someone's driveway and broke my arm. I was in the hospital for 4 days and underwent a 4 1/2 hour operation. I now have 12 screws and two plates permanently in my arm. I was reluctent to sue the person at first because we were friends but that situation has changed.

One potential pitfall could be that Homeowners Policies generally require the homeowner to notify the insurance company of any claims within a short period of time (30 days). After that, the insurance company may disclaim coverage and you would be left having to sue and recover solely against your former friend.

The statute of limitations for personal injury in NY is 3-years but there are caveats to that rule such as a municipality involvement.

There is a 3 year limit from the date on which the incident occurred. There are issues involving a legal concept called "notice" that you need to have addressed from what your posting states.
