The question is how bad are the burns?
You may, depending upon where the grating is located, who is responsible for it and the degree of injury.
You may have a case. I would like to see photos of where the grating is and if there are any warning signs. I handle these type of cases on a contingency basis so please feel free to check out my web site and contact me. If for any reason a munipality is involved, there is a requirement to serve a Notice of Claim within 90 days of the accident.
I am very sorry for your terrible ordeal.
You probably have a case but it depends on a number of factors. Some preliminary questions I have are: 1) how severe are your child's burns; 2) were there any warning signs about the grating; 3) is the grating located on the bank's building or is it in a location that would involve another business or municipality like the city; and 4) do you have photos of your child's burns and the grating.
