Legal Question in Personal Injury in New York

Trials in Nassau County

I had a work related back injury in NYC several years ago. The case is close to trial. My lawyer mentioned that if the case goes to trial, it will have to be held in Nassau County, NY since that is where I live. He said that historically, jurys in Nassau County award much less than other places (i.e. Brooklyn, Manhattan). Is this true or is this a way for him to convince me to settle?

As a rule, Nassau County, like Westchester, Richmond and Suffolk is considered more conservative in awarding money than Brooklyn or the Bronx. This is a generalization and may, or may not, apply in any one specific case. Good luck. Best, MEZ

Unfortunately, your attorney is telling the truth. Nassau county jurors are generally wealthier, more educated and more cynical than their Brooklyn and Bronx counterparts. They know that large personal injury settlements mean higher insurance premiums for everyone. They are also old-fashioned, self-made and often see personal injury plaintiffs as lazy and out for a quick "payday".

More importantly, why wouldn't you settle if you're attorney is trying to convince you to do so? Presumably, your attorney gets 1/3 of your settlement. Your attorney wouldn't let you settle if he/she thought a much greater amount could be gained after a trial.
