Legal Question in Product Liability in New York

Facial Burns

I bought a facial hair removal product from a company in New york, over the internet. After I recieved the product and did their test patch, I applied the product to both sides of my face. Immediately my skin began to burn so I washed off the cream with cool water. Soon after, welts developed where the cream was and my skin burned like crazy. The whole day and night my face got worse. I couldn't sleep. the next day the sores had opened and I looked like I had been dragged down a paved street on both sides of my face. I contacted the company and told them the story of my burned face. They haven't responded.

Do I have a case or do I simply chalk this up as a bad internet buying experience? Help!

Your question raises a number of issues. First, were there directions and appropriate warnings on the product you use and, if so, did you read and follow them explicitly? Also, is the seller a large manufacturer or merely someone who sold a homemade concoction? Is the product approved by the FDA and, if not, should it have been?

If I were you, I would start by doing some research on the product over the Internet. See whether your circumstances are common, and whether any other complaints have been registered along the lines of your circumstances.

From there, it would be easier to assess your potential case.
