Legal Question in Product Liability in New York

Frozen Confectionary Containing an Insect

On the evening of July 13th after doing our bi-weekly shopping at a national food chain, we consumed our family meal and finished with a frozen confection purchased at the same chain. One the first bite into her fudge bar, my wife crunched down on a large beetle type insect frozen into the treat. Could suggest any possible course of action at this point?

I recevied your posting on 9-8-2000.

Keep the object frozen. Take a photo of it. Write to the manufacturer to advise.

You should have some satisfaction.

Having worked for insurance companies and large corporations for many years, and now doing plaintiff's work for injured clients, any potential lawsuit will hardly be worth the effort unless something really bad occurred as a reult. Usually, the maufactureres are good about dealing with these things. They will also want to inspect the packagibg for quality contro number and batch numbers.

Good Luck
