Legal Question in Real Estate Law in New York

Adding wife to deed

Back in 1993 my wife and I purchased our home together but for some unknown reason she was not put on the deed to the house. What do I need to do to put her on the deed and what would be a ballpark figure concerning cost to get it done.

Re: Adding wife to deed

A new deed conveying the property will need to be filed with the county clerk as well as the transfer tax forms. The total costs for such an endeavor would be approximately $500.

Re: Adding wife to deed

As a matter of law, if you were married at the time, she is a co-owner. From a functional point of view, it should cost no more than about two-three hundred dollars or so...that will include the new deed (which will be minor) and the recording and filing fees with the Suffolk County Clerk. There will be no transfer tax because it is an intra-family transfer.

If you would like, my office can do this for you quite easily. Feel free to e-mail me [email protected]

Thanks and Happy New Year.

My fee would be $200. The recording fees should be less than $50.
