Legal Question in Real Estate Law in New York
We own an apartment in a home association in New York registered in NY state as non-for-profit. The Board of Directors is forcing members to sign a proprietary lease in which they clearly violate our rights (like taking the board to court should there be any disputes). We are also fined for not signing the lease, a non payment of which would, according to the board, cause a refusal of consideration of a potential buyers or refusal closing the sale. The fines are found ONLY in the new proprietary lease. Can the board impose such demands coming from the lease we haven't signed. What is our way out of their constant attempts to coerce us to sign using threats (of fine, of court, of not approving sale, etc.)
