Legal Question in Real Estate Law in New York
Asbestos roof
I purchased a 77 year old home in May 2002. An inspection was done and the report states that the roof is asphalt/fiberglass. I was told it would need to be replaced. I have since found out that the roof has asbestos tiles which needs to be removed by an EPA certified contractor( extemelt expensive). Do I have any recourse against the inspector for missing what two other people were able to see just by looking at the roof?

Re: Asbestos roof
According to what you wrote, you have a claim for negligent inspection, the damages for which are the cost of the removal by the EPA expert.

Yes, probably you do have a claim against the inspector.
