Legal Question in Real Estate Law in New York
my attorney represented me on the sale of a two family house in the bronx new york .I had two houses on the same blockwith the same lender Chase mortgage corp.It now turns out that my attorney asked the bank for the loan number and as you might guess got the wrong propeety and closed the loan on the wrong house. The bank sent me a letter stating that the loan was paid off and I discovered then that they had closed the wrong account.They are still billing me for the monthly payment at the house I just sold and they are also billing the new owner.Its a mess.The good thing is that the new owner also has Chase as its mortgage holder, but why Chase hasn`t seen this amazes me.My attorney said that he holds me 70per cent to blame for the mess but would help a bit towards fixing the problem.I am furious .Is he accountable wholly for not providing oversight as he was paid for ?do I need a malpractice attorney?please advise me.he said at the closing that he was too sick to give me the copies of the paperwork and would forward them asap but never did and it is now five months later and its a mess. Get another attorney and demand reimbursement form your previous attorney. Yes, its malpractice but the demand are minimal.
