Legal Question in Real Estate Law in New York

My aunts husband passed away last week, he was under 24 hour care, and the assistant was being paid by his daughter. The assistant now wants 60 days to move out, my aunt wants her out immediately. What do we do?

Was their an agreement regarding this situation. Was she from an agency. If not, try calling the police. If nothing works you will have to bring legal proceedings to eject.

In the absence of an agreement to the contrary, she is an at-will employee, whose employment may be terminated at the end of any pay period. If she refuses to leave, she is a trespasser.
