Beind Sued By Rental Unit Owner

Hello,

My husband and I applied for a rental unit in a NY co-op in November of 2006. The listing stated that there was private storage included, but when we went to the co-op interview, the brokers told us that this storage wasn't available to us. This was a big problem (it was a 450 square foot apartment!) and so we told the co-op board we would not be moving in. Now, over a year later, the owner of the building is suing us for 2 months rent plus the reduction in rent allegedly caused by our defaulting on the lease ($8000 total). We maintain that the property was misrepresented, she states that we should have inquired directly to her to rectify the situation with the private storage. My question: we are now in talks to settle for $4000, or half of what they are suing us for. I don't believe we owe them a thing, but my husband is worried that we could lose in court and end up having to pay what they are asking plus their legal fees. Any advice?
