Legal Question in Real Estate Law in New York

I bought a house and then found that the previous owner had left a big unpaid water bill going back more than a year. The county says the water bill is my responsibility as the current owner. But at the closing, both the previous owner and his attorney told me and my attorney that his bills were all paid. Can I sue him in small claims court?

It depends on the language in your contract. However, assuming that your contract calls for an adjustment in the water, then the answer is yes since an adjustment did not occur at closing.
