Legal Question in Real Estate Law in New York

We bought property 3 1/2 yrs ago, when it was surveyed it was brought to our attention that neighbor has infringed upon our property with coi pond. We have asked her to move it 3 times. Our attorney knew this right from the start, now he's saying we may hafta take her to court & that it would be expensive. What gives here? Also, same senario, we knew we had conjoined leachfield, which has been that way for 30 yrs, now we're being forced to install entirely new septic system because she don't want it that way anymore, does she hafta take us to court to make us do it? Also, there is an acre field next to both our properties, that has been being mowed for several years, do we both own what has been being mowed? Thanks in advance for your answer.
