Legal Question in Real Estate Law in New York

Boundary Problem

I own twenty acres, which was in my family since 1960. I have lived on this property all of my life (33 years). We ran a goat farm on the land from 1960 to 1985. The farm dates back to 1790 and is very much in tact, with regards to stonewalls and ancient wire fences. The deed to the property is very specific as to compass headings, landmarks (stone piles) and chains and links measurements.

I hired a local surveyor to find the corner markers. The surveyor and I walked the boundary lines and he used a viewfinder compass to follow the heading called for in the deed. We followed the wire fence and stonewall along the east boundary line and it was as per the deed. So were the stakes in the southeast and southwest corners of my property. Next, we walked the west boundary line and came out at the stone pile in the northwest corner of the land (called for in my deed). The surveyor stood on the stone pile and shot both compass headings called for in my deed and he proclaimed this to be the northwest corner of the property. Him and his assistant both remarked about the old wire fence grown into the trees and how the way it ran matched the compass headings called for in the deed.

Sounds like a great piece of land. And you tell a good story, too.

Re: Boundary Problem

I am not sure about your question and assume that the end was left off. Please re-send the entire question or clarify it for me. I assume you are seeking to quiet title to the property and establish its boundaries.

Kind regards,

Peter Moulinos
