Break a rental lease

I have a 1 year lease on a rent stabalized apartment in nyc. I have been relocated with my job and have 3 months remaining on the lease. I signed my lease at the top of the market and it is not hugely over-priced for the area. I have not been successfull in finding someone else to take over my lease, and the landlord is refusing to reduce the price. Do I have a case?

Unless you are in an area of Manhattan affected by the WTC, I find it hard to believe that any rent stab. apt. is now over market. Are you sure you are not being over-charged? The type of building, registration and use issues can all be reviewed and used as tools to get the landlord to agree to terminate the lease. While the normal rule is that you remain obligated under a lease for all periods the apt. remains unrented (LL must make reas. (effort to find a new tenant), I have rarely encountered an unrentable regulated NYC apt. You are welcome to call and examine the issues further (516-780-0270)
