Legal Question in Real Estate Law in New York

Broken Lease Agreement out of Necessity

I was transferred with my job from NY to Florida. Our new lease started 8/1/01. I gave the super the keys 9/1/01. The landlord was notified during 8/01 less than 30 days into new lease. The agent said it was okay to break lease since i was transferred with my job. I brought letter to office stating the conversation. Also we have no choice but to sign a lease or they will evict. Now they are trying to get $2300 (which equals aprox 3 months rent) for i'm assuming the time the apt was empty. Can they do this? Rent was up to date & apt was in good condition.

Re: Broken Lease Agreement out of Necessity

It depends on what is written in the lease, so look at it carefully and this anser will be in there. Otherise, I cannot provide advice about a lease or apartment issue in Florida. If this is about a New York State property, my answer would probably be the same.
