Legal Question in Real Estate Law in New York
My brother asked to use my expensive camera to take pictures of his shoes to sell on ebay, I said he could use it as long as he put it back in my room. He failed to do so and consequently the camera was destroyed by our dog because he left it on a computer desk in another room. He refuses to pay me back, it has been a year now, and I even offered for him to pay for repairs or a new camera of a similar type. Can I take him to small claim court and win?

You may commence an action in small claims court if (1) you are over 18 years, (2) the individual that you are suing is over 18 years, (3) the individual you are suing resides in the county where the court is located, and (4) the amount you are suing for is under the jurisdictional amount for small claims court (generally, $5,000).
