Legal Question in Real Estate Law in New York
My brother owns a house in NY State. My name is on the deed. Can he sue me for past (and future) mortgage and tax payments that he has made?

Question unable to be answered without knowing more facts. Why is your name on the Deed? Are you really a co-owner? Who reports and takes the deductions for income tax purposes (mortgage interest, real estate taxes, etc.)? In theory, as a co-owner, you could be responsible for payment of these expenses. On the other hand, you might require your brother to pay rent which might cover these expenses. It appears that based upon Deed registration, you and your brother are the equivalent of partners owning the house. I suggest having some written, notarized document spelling out your rights and responsibilities.
