Legal Question in Real Estate Law in New York

My brother is trying to refinance his house. He has had the mortgage held by the original owner for the last few years. Now that he is getting the house in his name completely and refinanced in his name the owner of the house is refusing to give the bank a payoff amount. What can he do?

You would have to commence an action to discharge the mortgage under Article 19 of the NY RPAPL.
