Legal Question in Real Estate Law in New York

Brother & 2 Sisters own a mortgage-free house in New York. Only Brother lives in it and is not paying rent or property taxes. We want him out to sell house. Please advise.

I assume "we" are the two sisters.

Since the house is owned by the three individuals, you would have to commence a partition action to sell the house. You will not be able to evict your brother since he is an owner of the house.
