Legal Question in Real Estate Law in New York

Certificate of Occupancy

I purchased and closed on a new contruction condo over a year ago in a 14 unit building. At the time there was a temporary certificate of occupancy. That has since expired and the sponsor/builder of the project still has not obtained a certificate of occupancy from NYC building department. I want to sell my condo and move to a different state but I can't until I get the certificate of occupancy. I have been told it could take up to a year to obtain because some of the issues are major. Do I have any remedies against the builder?

Re: Certificate of Occupancy

Your contract probably states that the sponsor can close with a temporary certificate of occupancy.

I would contact the Attorney General's office and file a complaint.

Mike.
