Changing Buyer's Attorney in the Closing Process
Hello. We are buyers.We are stuck with this Real Estate Attorney who is not cooperating with us in the closing. Our Loan is approved and we crossed our closing date as of today. Hence we want to choose a different Real Estate Lawyer. Present lawyer is playing tricks saying that Seller is busy, Bank Attorney is busy .....; After investigating, all these people are ready except our attorney (Buyers). All becoz, we have not opted his recommended Mortgage lender.How does it work? I have not signed any contract with my lawyer. They have done Title Services also. Please advise? How to change Buyers attorney at this stage.? Our Lender, Sellers Attorney have this attorney representing us the buyers. Can we select a different attorney? How does it work? We want to do it asap as time is running out.Please Help.We appreciate your suggestions.

You can fire your attorney and retain a new one at any time.

you have every right to change attorneys and it would not be difficult for you to retain one for your closing. While you may be liable to your original attorney for some legal fees, you may very well have justifiable cause not to remit his fees to him due to his alleged malfeasance. With everything done, the only thing stopping another attorney from stepping in is being in the dark. Plus, you will owe the current attorney $ for the services to be performed. But if it is a simple matter of just representing you at the closing, and all of the title work is done and the bank has cleared you to close, it "ain;t no big deal".

It is your right to fire your attorney for "cause" or for "no cause" at any time. However, he/she is due $$ for the work he has done which is the bulk of the work.
