Legal Question in Real Estate Law in New York
closing on a home purchase
I have a suspicion that the homeowner is not aware or being honest in regards to a buried old oil tank. I found a feed line out to the yard & it stops about 10 feet from the back of the house. He currentlty has an above ground tank in the basement. The contract was as is for the house & he said he would have no problem singing a waiver to the possible buried or abandoned tank. I want to know if getting him to pay for it after the sale & singing the waiver is possible.
Thanks
Chris from NY

Re: closing on a home purchase
Once the sale is over, the money usually ends.
You'd need to enforce the waiver in court if he refuses to honor damages casued by it.
