Legal Question in Real Estate Law in New York

condominium association

Our condominium association consists of three condos within one building (until recently a large single family dwelling), all sharing the same address. We have a dispute with our neighbor who borders our property. There is a dead tree that touches each of our property lines, and is in need of removal. Our question is: are we considered one entity or three in terms of splitting the cost for tree removal with our neighbor?

If the tree is located on the common area, then it would be one entity. In other words, the cost to remove the tree would be paid by the condominium association.
