Legal Question in Real Estate Law in New York

Is it a conflict of interest if the Buyer and Seller both use the same attorney, and the Buyer has given that same attorney Power of Attorney for the closing. After the transaction the Buyer has discovered that the attorney wrote N/A on the Disclosure Document, not disclosing problems with the house, and signed the Disclosure document for the Buyer. Immediately after the sale the boiler/furnace broke, and now the Buyer is having to pay $15,000+ for replacement of the boiler and asbestos removal. The installer said that the boiler was 50 years old with parts that have been unavailable for 15 years.
