My co-op board wants to evict me and my dog

I am a co-op owner and have purchased a maltese dog a few months ago. My proprietary lease and house rules does not specifically state that I cannot have a dog.

However, the co-op application did state that no pets are allowed. My co-op board has recently asked me to remove my dog within a month or will evict me. I know for a fact that there are numerous pet owners in the building (the co-op president owns 2 cats). I want to keep my dog and my apartment. Do they have a right to remove my dog or evict me?

After reading your by-laws, the answer is that the cooperative has the discretion.

However, please let me know if any other lawyer comes up with a different answer that you may utilize.
