County taxes not paid at refinancing

I refinanced my home in 12/02. I had money in my escrow account to pay the upcoming tax bill. At the closing, no mention was made of who was paying the taxes. The mortgage holder took 6 months of the tax bill for the new escrow account and refunded me the balance in the old escrow account. I just received a bill for my 2003 county taxes with penalties and late fees assessed because the taxes weren;t paid by the lender. I will have to pay the tax bill to keep the house current, but what recourse do I have against the lender and the title attorney for not disclosing this at closing?

Title company should have picked this up. Send them a claim letter.
