Legal Question in Real Estate Law in New York

Can the current Remainderman on a Life Estate ADD a Spouse as a Joint remainderman? My wife is the Remainderman on a Life Estate with her Mother as the Life Tenant. Can my wife add me, her Husband, as an additional Remainderman? If so, will it affect anything with the Medicaid look back period since it has already passed?

No. Your wife and mother would have to sign a new deed. Be careful here with Medicaid as it's tricky business, as you know.

Good luck.
