Who should cut the tree?

My neighbor has a tree that is growing over my fence into my yard. I was going to cut the part of the tree that was in my yard and was told by my neibhor that she would sue me if I caused any damage . The tree is leaning over the neibhors house and if I cut my side it will make it lean further onto her house.

The answer to your question could depend on local laws, community regulations, or your homeowner's association rules. You need to check these out, but the Nolo book is a good place to start.
