damage by our tree to our neighbor's fence

Are we legally obligated to pay for damage that a fallen limb from a tree on our property caused to our neighbor's fence? Thank you.

If you had either actual or constructive notice (inferred) that something was wrong with the tree you are responsible. If there was no prior notice of any problem with the tree you are not responsible for this act of nature.
