Legal Question in Real Estate Law in New York
why is there a need for a death certificate
My sister back in 1971 talked my mother into giving her the family home before she my mother remarried. Before my mother death (recently) my sister was trying to get a copy of my fathers death certificate. I found a copy of a notorize statement by my mother back in 1993 which stated that she had given the house to her not even mentioning that she had another daughter (me) and saying at the end ''On my daughter insistence and against my better judgement I put the house in both her name and her husband''.
All this info is new to me but why in October 2002 would my sister still need my father's death certificate?

My guess is that your sister is trying to sell the property, and she needs the d/c to keep the chain of title clean.

Probably to prove she is the surviving joint owner with the sole right to title.
