Legal Question in Real Estate Law in New York

Deceased's home

My boyfriends Mother passed away in November and it has been a big mess. We are going to move into the house after we fix some problems. Are we responsible for the utilites since we are not living there or does it come out of the estate?

Re: Deceased's home

Your question is a little confusing. When you say "fix some problems" does that refer to the house?

An estate is a separate legal entity. So if you are going to move into the house you would either have to purchase or lease the house from the estate. If you are going to fix the house, a separate agreement should be entered into between you and the estate. And if you are living in the house under a lease agreement, there should be an agreement concerning utilities.
