Legal Question in Real Estate Law in New York

Deed not in my name

When I applied for a reverse mortgage, it was discovered that my house is still in the name of the company my father bought it from in 1934. The mortage was paid up years ago, but the house was never transferred to my or my father's name. He is now deceased. I have been paying the taxes since his death in 1956. I managed to get the reverse mortgage but now what do I do to get the house in my name so my heirs will be able to sell it?

Re: Deed not in my name

The prior answer is correct unless you can locate the company that originally sold the property, which is most doubtfull.

I concur with Phroska that a suit is needed to settle the matter. You will need as much documentation as possible. If the original company on the Deed is no longer in existence, you may have to find out how it went out of business, if there is a successor who could execute a new Deed, etc. If not, you will have to advertise publically in accordance with court rules. Re: Deed not in my name

You require an "Action to Quiet Title," for which you will probably Need a Laywer. Hopefully, you have the original Contract of Sale and other docs needed to support your claim.

Good luck,
