Legal Question in Real Estate Law in New York
Deed VS Will
My Mother passed away 2 wks ago. She has a 2nd mtg on house w/oldest son. Her will states the house is left to her 4 children. We have found that the son's name is also on the title. Does her will superceed the title?

Re: Deed VS Will
No.
Depending on how the property is held, the 4 children may split a percentage or the oldest son may own the entire piece. It would be necessary to see the deed to determine that.
