Legal Question in Real Estate Law in New York

deposit disputes

I am not sure how to go about fixing this situation.

We rented a house for a year in NY, and are now living in another state. We tried to get our deposit back, but the landlady refuses, on charges of damages, which were bogus. She was suppose to mail us the receipts of those things that needed fixing. She never did, on top of that she has a personal handy man that does all the work who could write false receipts. Her house was not up to code including not having a floor, just panel board. Small Claims? Do I have to go back to NY? Can anything be done from where I am now?

You will have to take her to small claims court here in New York. You may not need to return here, but you will need to get an attorney who can represent you here. You will need to provide detailed allegations, so that your attorney can draft papers for you to sign. You should attempt to get an attorney local to where you rented the house.
