Legal Question in Real Estate Law in New York

The developer of the property next to mine has several trees which are on a rise above my house. I am concerned that their condition is such that they may fall over in a bad storm and damage my house and/or lot. Should I send a letter to the developer noting same and claiming that any damage shall be his responsibility if this should happen?

Yes. I would also send it certified mail. Also, I would make the letter factually informative and not "nasty."
