Legal Question in Real Estate Law in New York

Disclosure by Real Estate Agent

My husband and I bought a house last Fall. I went to see it with a real estate agent from the listing office. My husband saw the house after we bought it. We had the house inspected before purchasing it. Neither the real estate agent nor the home inspector told us that the upstairs of the house had no heating ducts for the forced air heating system and I did not know from looking at the vents that there were no ducts. Do we have any legal recourse against the real estate agency or the home inspector?

Re: Disclosure by Real Estate Agent

You may have a claim of fraud against the broker/agent and a claim of negligence or breach of contract against the inspector. If the inspector and real estate professional worked together to deceive you, and you can prove it, then you may also have a claim of civil conspiracy against both of them. You will need to consult with a lawyer to learn whether you have a viable claim that's worth pursuing. Good luck.
