Legal Question in Real Estate Law in New York
I am the dominant of a right of way to a 24' strip of land to access the lake and for me to use. The New York deed states I cannot build structures on this land but that I am responsible for maintenance . The servient said that I can put a stairway down the hill but he wants pavers so as to keep it 'natural' . I had wooden stairs put in with a railing , but he does not like it and said he thought it would be all paver bricks. I am disabled and need a railing to hold onto until I get to a slight hill area where I can walk on the pavers with no trouble using my cain or being very careful. Because I am handicapped do I have rights as to having stairs / ramps put in so I can safely access ?

Would need to read deed and any other document establishing your right of way.
