Legal Question in Real Estate Law in New York

Next door property owner doesn't secure property and now my property is damaged

I have a party wall (fence) with my neighbor.

My neighbor's property is commercial and residental,

mine is all residental.

After the business is closed, children that live on our street and in the property next door, play in the commercial properties'portion of the parking lot, which is right next to the party fence. Kids are damaging

our party fence. They play baseball, tag, etc, etc., and bounce against the fence. This fence is now damaged and the fabric is stretched out of shape. I post signs to be careful etc etc. I can't be a 24-7 guard against kids. Who's responsible for damages and what can I do to ''move'' the situation along. I spoke with the owner and he blows my off. Unacceptable. Help Please.
