Drainage

I recently purchased a home in upstate NY. We purchased the home from a developer but the home was built by the neighbor. The neighbor says that during the build, the land was improperly graded and this is causing drainage problems on his property (his property is lower than mine). As a result, he is planning on suing me to resolve his drainage issue. Does he have grounds or is his case with the developer?
