Legal Question in Real Estate Law in New York

Enforce Divorce Jugment via Lien

My x-husband has refused to pay me $50,000 which he was ordered to pay in the divorce judgment. Can I put a lien on his property for $50,000 so if he ever trys to dell his property, he has to pay me the $50,000?

Re: Enforce Divorce Jugment via Lien

Unless the divorce decree was worded as a monetary judgment and entered as same you will probably have to start an action against him to enforce the payment provision. Speak to the matrimonial clerk of the court. Good luck. Should you have a matter in South Florida please contact me.

It depends on how the Judgment of Divorce is worded.

If the Judgment specifically grants a monetary award, not only is the Judgment a lien on the real property, but you can also contact the Sheriff and have the property sold.
