Legal Question in Real Estate Law in New York

Entry to apartment

The maintenance man at our apartment complex has entered our apartment without our knowledge or permission. Before we complain we want to make sure if we have the right to do so. The reason for his entering was to fix a light fixture. We think he should have waited until we were home.

Re: Entry to apartment

Check your lease first. Usually the landlord has the right to make entry for repairs without notice, but usually only for emergency repairs. This was not an emergency!

However, is someone available during the hours the handyman works? If not, the entry may have been permissable.

I suggest a call to the landlord indicating that the repair was not an emergency and suggesting in the future that entry only be while someone is home, unless there is no available workman during those times.
