Legal Question in Real Estate Law in New York

eviction

we have a dog, a pitbull, when we moved in we told him what kind of dog we had, and put in on the application, 2 months later he says we have to move out because he is a pitbull. Now he gave us a 3 day notice to quit. on april 2, i told him we would be moving out the following friday, he said that is not good enough and my question is can he kick us out with out the eviction notice from the courts and put us on the street before friday

Re: eviction

Hi:

It does not appear that your landlord would be able to get a notice to evict that quickly. However, since this appears to be an escalation of emotion, I would try and speak with him again, and if not satisfied I would speak with a lawyer.

Good Luck

Re: eviction

It sounds as if you have the legal right to remain until the lease agreement expires. The landlord must get a court order to evict you. You may want to come to an agreement and move out prior to the expiration of the lease. I would make sur you get the releases from your lease obligations. I would speak to a real estate attorney.
