Legal Question in Real Estate Law in New York
Eviction notice when rent has been paid
I have mailed my monthly rent check which was not received by management. One month and a half later I mailed in a check for two months rent. A day later, I have received an eviction notice from court for non-payment of rent. Now, it will be reported on my credit history report and overall causing me a lot of emotional distress. I have not received any notices from my management. My payments were normally made in a timely fashion. I have been renting this property for over two years. When I rented it out, it was not in a livable condition but I fixed myself and never complained to the management. My question is if I can file a lawsuit against my management for causing so much distress for nothing (as of today, everything has been paid in full)
Thank you for your help.

Re: Eviction notice when rent has been paid
your first concern should be the eviction notice that you received.. there is a cause of action for damage to credit but that would come later there are other ways to accomplish that you can call me at 212 683 8677
