Legal Question in Real Estate Law in New York

Me and my family have been living in a house paying rent for going on 3 years and was told by courts and banks that the house was in process of forclosure. The owner is still demanding rent and trie to convince us that the house is for sale not forclosure. How do we find out if it is in fact forclosed and how long do we have to stay in the house and what about utilities since those are also in the owners name?

You can check the county clerk's records. There is a website you reach via www.ny.gov. Follow the links for "government", "agency listings" and "court administration, office of". Click the links for 'attorneys' 'decisions' and weblinks supreme. Search by the name of your landlord as a defendant. That will hit the foreclosure case IF a judge has been assigned. A judge has to be assigned at least several months before the foreclosure can become binding.

You should be in touch with the utility companies. Make sure they know there is a tenant.

Do not pay rent if there is a pending foreclosure. Use the rent money to pay back utility charges if they threaten you with a disconnect. Talk to the bank about taking over the loan after the foreclosure. Keeping possession depends on many factors, but you could have a mover at your door in a month, so talk to the bank.
