Legal Question in Real Estate Law in New York

Can I fire my lawyer?

We are selling our co-op and have had nothing but problems with our lawyer. In fact, it wasn--name removed--until my wife and I started dealing directly with the buyer's lawyer, the co-op company, and the buyer's lender did the deal start to move forward.

He continues to send us documents with errors... including basic things like mispelling our names. He fails to follow-up on matters requiring us to remind him daily to make the calls he needs to make. Since we moved out of state, he knows we won--name removed--need him for future business and doesn--name removed--seem to be commited to our case.

Unfortunately, the closing is now scheduled (thanks to my wife) and we are afraid if we fire him, we may push the closing another month or two, or potentially lose the deal. However, we are disgusted by the fact that we will need to pay him.

Do we have any options? We've made our dissatisfaction very clear on multiple occasions and he doesn--name removed--seem to be bothered, because he knows we can--name removed--switch lawyers at this late stage.

Any ideas would be appreciated.

Re: Can I fire my lawyer?

If you are unhappy, you should hire another lawyer. Ask the realtor to reccomend three people to call or call me. To represent a seller at a co-op closing is fairly simple and should not delay your closing very long if at all. As to his bill, get ask for a detailed bill so you can contest each entry. Do not authorize the buyer's lawyer to pay him at the closing and file a complaint with the District Ethics Fee Arbitration Committee. You may have to appear or you can possibly submeit a notarized affidavit
